Terms and Conditions
These are the general terms and conditions of use for the Multimap Site, which is owned by Multi Media Mapping Ltd., trading as Multimap and Multimap.com. Please read these terms and conditions carefully. Your use of the Site and the Services will be subject to these terms and conditions.

Definitions
In these terms and conditions, the following definitions apply:
"Service" means any information and services, including mobile services provided by Multimap through or via the Site, or to mobile devices;
"Multimap" means Multi Media Mapping Limited, whose registered office is at 165 Fleet Street, London EC4A 2DY;
"Site" means the Multimap web site or WAP site.

What you are allowed to do

You may use the Service for personal use and in accordance with these terms. Certain parts of the Service - in particular the mobile Services - are payment-only. Additional terms apply to such parts of the Service and may be reviewed below.

You may:

browse the site using a compatible web browser. Permission to browse the site includes permission to make transient or cached copies of parts of the site to the extent that this occurs in the normal course of using your browser and that these copies are used only to facilitate current or subsequent access to the Site by you;

print a copy of any page of the Site,
for your own personal purposes, provided you do not do any of the things set out under "What you are not allowed to do".

What you are not allowed to do

Except to the extent expressly set out in these terms, you are not allowed to make any copies of any part of the Site.

You may not remove or change anything on the Site.

You may not print more than 10 copies of any maps or other materials from the Site. If you require more than 10 copies, please send a request to info@multimap.com

You are not allowed to copy or use any material from the Site for any commercial purpose.

You are not allowed to capture any map images, map data or lat/lon information from the Site.

You are not allowed to reverse engineer the Multimap Application Programming Interface or any of the XML and other calls made by the API.

You are not allowed to remove or change any copyright, trademark or other intellectual property right notices contained in the original material or from any material copied or printed off from the Site.

You must only use the Site and anything available from the Site for lawful purposes, and you must comply with all applicable laws, statutes and regulations. You must not use the Service to:

post, upload or otherwise transmit information or pictures that are obscene or pornographic, threatening, menacing, racist, offensive, defamatory or otherwise unlawful;

upload files that contain software or other materials in breach of any intellectual property rights or in breach of confidence;

download any file or materials posted by another user that you know, or reasonably should know cannot be copied or otherwise used;

harass, stalk, threaten or otherwise violate the rights of others;

harm or threaten to cause harm to minors;

impersonate anyone else or otherwise misrepresent your identity or status;

hack into the Site or any other related computer system, make excessive traffic demands, deliver viruses or forward chain letters, surveys, contests, pyramid schemes or otherwise engage in any other behaviour that may reasonably be expected to inhibit other users from using and enjoying the Site or any other web site or damage or destroy the reputation of Multimap or any third party; or

collect and process others' personal data.

Multimap accepts no obligation to monitor the use of the Site. However, Multimap reserves the right to disclose any information as required by law and/or to remove, refuse to post or to edit any information or materials, to block your access and to take such other action as may be reasonably necessary to prevent any breach of these terms and conditions or any breach of applicable law or regulation. Multimap will also in its absolute discretion fully co-operate with law enforcement and other relevant authorities with respect to any investigation of suspected unlawful activity or violation of network security.

Your personal information
Usage of your personal information is governed by Multimap's Privacy Policy, which forms part of these Terms and Conditions. In the event that Multimap undergoes reorganization or is sold to a third party, you agree that any personal information Multimap holds about you may be transferred to that reorganized entity or third party.

Rights
All intellectual property rights in any material (including text, photographs and other images and sound, trade marks and logos) contained in this Site is either owned by Multimap or has been licensed to Multimap by the rights owner(s) so that Multimap can use this material as part of its Site. You are only allowed to use this Site and the material contained in the Site as set out in these terms.
The reproduction, copying, downloading, storage, recording, broadcasting, retransmission and distribution of any part of the Multimap.com website is not permitted without prior written consent of Multimap.com. The user does not receive any, and Multimap.com retains all, ownership rights in the information. The information is copyrighted and may not be copied, even if modified or merged with other data or software. The user shall not alter or remove any copyright notice or proprietary legend contained in or on the information. Disclaimer and limitation of liability

Multimap does not, and nothing in these terms and conditions shall act to exclude or limit Multimap's liability for death or personal injury resulting from its negligence, fraud or any other liability which may not by applicable law be excluded or limited. Your statutory rights as a consumer are not affected by any of these terms.

Subject to clause 6.i, in no event shall Multimap be liable (whether for breach of contract, negligence or for any other reason) for any loss of profits, exemplary or special damages, loss of sales, loss of revenue, loss of goodwill, loss of any software or data, loss of bargain, loss of opportunity, loss of use of computer equipment, software or data, loss of or waste of management or other staff time, or for any indirect, consequential or special loss, however arising.

Subject to clauses 6.i and 6.ii, Multimap's liability to you whether in contract, tort or otherwise is limited to the amount paid by you in respect of any paid-for Services.

You agree that your use of the Service is on an "as is" and "as available" basis and that your use of the Service is at your sole risk. On that basis, except as expressly set out in these terms, Multimap does not enter into conditions, warranties or other terms in relation to the Site or the Service (including any implied term relating to quality, fitness for a particular purpose).

You agree that the obtaining of any material through the use of the Service is carried out at your own risk and that Multimap has no liability to you in respect of such material or the effects of such material.

Multimap tries to make sure that all information contained on the Site is correct, but it does not accept any liability for any error or omission. You should check with Multimap or the relevant supplier before acting on any information on the Site.

Multimap may change the format and content of the Site from time to time. You should refresh your browser each time you visit the Site to ensure that you see the most up-to-date version of the Site.

The Site includes links to external sites and co-branded pages. Multimap has included links to these sites and co-branded pages to provide you with access to information and services that you may find useful or interesting. Multimap is not responsible for the content of these site and pages or for anything provided by them.

Suspension and termination of Service

Multimap may suspend the operation of the Site for repair or maintenance work or in order to update or upgrade the contents or functionality of the Site from time to time. Access to or use of the Site or any Sites or pages linked to it will be not necessarily be uninterrupted or error free.

Multimap may terminate the Service immediately in the event you breach any of these terms and conditions or if you are late in or do not pay any sums due to Multimap or any company in Multimap's Group.

Multimap may change these terms and conditions from time to time and will endeavour to notify you of any major changes by posting a message on the Site. By browsing the Site you are accepting that you are bound by the current terms and conditions. You should check these each time you revisit the Site. These terms and conditions form the entire understanding of the parties and supersede all previous agreements, understandings and representations relating to the subject matter. If any provision of these terms and conditions is found to be unenforceable, this shall not affect the validity of any other provision. Multimap may delay enforcing its rights under these terms and conditions without losing them. You agree that Multimap may sub-contract the performance of any of its obligations or may assign these terms and conditions or any of its rights or obligations without giving you notice.

Multimap will not be liable to you for any breach of these terms and conditions which arises because of any circumstances which Multimap cannot reasonably be expected to control.

These terms and conditions shall be governed and interpreted in accordance with English law, and you consent to the non-exclusive jurisdiction of the English courts.

Additional Terms and Conditions of use for mobile services
Mobile services
All terms and conditions of use that apply to Multimap's web-based services apply to our mobile and WAP services (please see Terms and Conditions). You may not retain or retransmit any of the maps or other location information that we send to your mobile phone. The Services are for your personal use only. The Services are provided "as is" without warranty of any kind. Multimap accepts no liability or responsibility with respect to any loss or damage arising from use of the service or the information sent to your phone.
Using the mobile services
- When you ask us to send a map to your mobile, you will be sent a link to a map. Each time you click on the link, you will be charged 25p; mobile network charges may also apply. You will not be charged until you click on the link. You will be able to view the map 10 times over a 24-hour period and you will be able to zoom the map in and out.
- The map you receive will be optimized for viewing on a mobile screen; it may not be the exact map that you see on Multimap, but it will cover the same area.
- This service currently only works with mobile phones on UK-based mobile networks; we plan to extend the service to other countries soon.
- Please note that Multimap and its partners will not be able to provide refunds if you experience difficulties with this service. For other assistance, please write to info@multimap.com.
Ordering & Payment
In order to use Multimap's mobile Services, you must have a mobile communications subscription with a participating carrier or otherwise have access to a mobile communications network. Your phone must be capable of supporting WAP, and should have a color screen. If at any time your mobile phone or its software causes interference with our mobile Services or our website, your use of the Services may be immediately discontinued. Multimap reserves the right to make changes to the mobile Services that may require upgrades to your mobile phone or software to access the mobile Services. It is solely your responsibility to affect any such changes at your expense.
By completing the order process for the method by which you choose to access the mobile Services, you agree to pay for such mobile Services and authorize Multimap and your mobile communications service provider to bill you on your mobile phone monthly bill.
All purchases are final once you complete the purchase process; Multimap and its partners regret that we are unable to provide refunds. If you cannot receive the selected mobile service, please contact customer support by sending an email to info@multimap.com.
Phone location
For some of our mobile Services, we will try to determine the location of your phone using Cell-ID, a method of determining the position of a mobile phone relative to the network cell it is using (also referred to as "LBS look-up"; LBS stands for Location-Based Service). Although this method is useful for positioning, it is not as accurate as using GPS technology; in the countryside, Cell-ID could show a mobile phone as being as much as a kilometer from its actual position. It should also be noted that most network operators do not guarantee the availability of this positioning technology. For this reason, Multimap offers users of our mobile Services the ability to search by postal code or town name in the event of an LBS failure.
Your personal information
When you ask Multimap to send a map to your mobile phone, or when you log in to the MyMultimap Mobile Services on your phone, you are opting in to receive information from us related to these Services. By opting in, you agree that we may send you information about other mobile Services, or service enhancements, in the future. If you do not wish to receive any marketing messages by text, you may opt out by sending a request to info@multimap.com. Please put "mobile opt-out" in the header of your message, and please be sure to include your full mobile number in the text of the message.
You can also opt out of text marketing messages by simply replying "no" to any message you receive.
Limitation of Liability
In no event shall Multimap, its officers, agents, or employees, or its subcontractors, be liable to you for any indirect, special, incidental or consequential losses, damages, or expenses whatsoever, including, but not limited to personal injury, loss of use or non-operation of your mobile phone, or costs to repair or replace any of your property.
Multimap will not be liable to you in any way for failures, defects or delays in the delivery of the mobile Services. In no event shall Multimap's liability to you with respect to any portion of the mobile service exceed the price paid by you to Multimap for that portion of the service.

Multimap's mobile Services are provided through a partnership with 2ergo, a leading provider of interactive and multi-channel communications solutions using mobile technologies, fixed-line telecommunications and the internet. 2ergo's contact details appear below.
